Lease Agreement Notarization

A residential lease agreement is governed by the applicable tenancy laws and must be made in writing, containing all essential terms and conditions.

Although notarization is not legally required, we at Biliskov Real Estate often recommend having the lease agreement notarized to provide additional legal security and protection for all parties involved.

Tax Aspects of Property Rentals

As of January 1, 2024, changes to the taxation of rental income came into effect. Property owners should take these rules into account when renting out their properties.

Tax Rules

Income Tax Rate
Income earned from renting or leasing property is subject to a 12% income tax. This rate is applied to the net rental income, which is calculated by deducting allowable expenses from the total rental income.

Definition of Rental Income
Rental income is defined as the difference between the total rent received and the deductible expenses incurred during the relevant tax period.

Deductible Expenses
Under Croatian tax law, 30% of the rental income is recognized as deductible expenses, reducing the taxable income accordingly.

Tax Payment

Payment Deadlines
Income tax must be paid monthly, no later than the last day of the current month for the previous month's rental income, ensuring timely fulfillment of tax obligations.
